Autounfallmarkt is an online platform operated by Autounfallmarkt GmbH ("we", "us", or "our") for the auction and sale of damaged and accident vehicles. By registering on our platform, you confirm that you are at least 18 years old and legally capable of entering into binding contracts.

2. User Accounts

You can register as an "Individual" or a "Company" on our platform. You are responsible for maintaining the confidentiality of your account details and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.

3. Auctions and Bidding

• All vehicles are offered on an "as is" and "where is" basis. The descriptions are provided for informational purposes only, and buyers are responsible for verifying all vehicle details before placing a bid.
• Bids are legally binding. Once a bid is placed, it cannot be retracted.
• The "Buy Now" feature allows a user to purchase the vehicle immediately for a fixed price, ending the auction.
• The highest bidder at the end of the auction wins the vehicle.

4. Payment and Order Process

Once you win an auction or use the "Buy Now" feature, you are obligated to complete the purchase. An invoice will be generated, and payment must be made via bank transfer within the specified timeframe. Your order will be processed only after we receive and confirm the payment.

5. Vehicle Condition and Disclaimers

All vehicles listed on Autounfallmarkt are damaged, accident, or salvage vehicles. We make no warranty, express or implied, as to the accuracy of the vehicle description, condition, or mileage. We strongly recommend that you or your representative inspect the vehicle before placing a bid. We are not liable for any discrepancies found after the purchase has been finalized.

6. Limitation of Liability

Autounfallmarkt GmbH, its affiliates, employees, and partners will not be liable for any damages, whether direct, indirect, incidental, special, or consequential, arising from the use of our services or the purchase of a vehicle through our platform.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Germany. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Germany.
